Advanced Equine Recovery & Rein Maker Ranch, LLC – Liability Waiver & Informed Consent At Advanced Equine Recovery, located at Rein Maker Ranch,LLC we provide non-veterinary equine therapies intended to support equine recovery, conditioning, and overall performance. These services are not a replacement for veterinary care. They are provided to support the horse’s physical condition, recovery, and wellness. Informed Consent & Assumption of Risk By signing this agreement, I affirm and acknowledge that: Voluntary Participation: I am voluntarily choosing to allow my horse to receive services at Advanced Equine Recovery, Rein Maker Ranch, LLC and by their owners, employees, contractors, volunteers, interns and associates. Non-Veterinary Services: I understand that the services offered are not administered by licensed veterinarians and are intended as supportive therapies only. Risk of Injury or Death: I understand that equine activities and therapeutic services inherently involve risks, including the possibility of injury, illness, worsening of a condition, or death to my horse, or injury to myself or others involved. I accept these risks knowingly and voluntarily. No Guarantee of Outcome: I understand that no specific result or outcome is guaranteed and that results vary based on the horse's condition and response to therapy. Third-Party Providers: I understand that some services may be performed by independent providers or trainers who are not employees of Rein Maker Ranch or Advanced Equine Recovery. I release the business from liability for any such third-party actions. Emergency Care Policy In the event of an emergency affecting my horse while in the care of Advanced Equine Recovery: I authorize staff to contact my veterinarian, listed herein. If my veterinarian is not available, I authorize Advanced Equine Recovery to contact their preferred or on-call veterinarian. I agree that all veterinary, medical, or emergency costs are my sole responsibility, regardless of which veterinarian provides care. Gross Negligence Limitation & Legal Clarification I agree and understand that: This waiver releases Advanced Equine Recovery and Rein Maker Ranch, LLC and its owners, employees, contractors, volunteers from liability for ordinary negligence to the fullest extent permitted by Oklahoma law. I will not bring any claim for gross negligence unless it meets the following legal definition and is proven in a court of law: “Gross negligence,” for purposes of this agreement, means conduct so reckless or lacking in care that it constitutes a conscious and voluntary disregard for the safety of horses or persons. It does not include errors in judgment, isolated mistakes, failure to anticipate outcomes, or ordinary negligence. I agree not to allege gross negligence without substantial factual evidence and a good faith legal basis. The existence of an adverse outcome, by itself, shall not be used as proof of negligence of any kind. Remedies for Frivolous Claims I agree that if I bring a claim or legal action alleging gross negligence against Advanced Equine Recovery, Rein Maker Ranch, LLC or any of their owners, employees, agents, volunteers, and affiliated providers and such claim is determined by a court to be frivolous, unfounded, or brought without substantial supporting evidence, I shall be responsible for reimbursing the full amount of: All legal fees and court costs incurred by the business in defending such claim, Any resulting lost income or business disruption caused by the action, Any additional expenses related to damage control, reputation management, or professional liability insurance premiums. I acknowledge that this clause is intended to discourage misuse of the legal system and does not prevent or discourage valid legal claims supported by good faith and objective evidence. Indemnification & Release of Liability I agree to indemnify and hold harmless Advanced Equine Recovery, Rein Maker Ranch, LLC their owners, employees, agents, volunteers, and affiliated providers from any and all claims, damages, costs, or liabilities arising from participation in any services or presence on the property. If any portion of this waiver is found invalid under Oklahoma law, the remaining sections shall remain in full effect. Dispute Resolution – Mediation Requirement Before filing any lawsuit or formal complaint related to services rendered: I agree to submit any dispute to formal mediation in McClain County, Oklahoma, or another mutually agreed location. A neutral mediator will be selected jointly by the parties. Mediation costs will be shared equally; each party bears its own legal costs. No lawsuit may proceed unless good faith mediation has been completed first. Any legal action filed prematurely may be stayed or dismissed pending compliance with this clause. Oklahoma Equine Activity Liability Act Notice In accordance with the Oklahoma Livestock Activities Liability Limitation Act (Title 76 O.S. § 50.3): “Under Oklahoma law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.” By signing this waiver, I acknowledge and accept this notice and agree to release Rein Maker Ranch, LLC, Advanced Equine Recovery, and all affiliated individuals from claims related to inherent risks of equine activity. Severability If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalidity of one clause shall not affect the enforceability of any other part of this agreement. Acknowledgement of Understanding I certify that I have read and fully understand this waiver and informed consent form. I am signing voluntarily and acknowledge the risks and protections described above.
